What is a SARS Voluntary Disclosure Programme (VDP) application?

A Voluntary Disclosure Programme (VDP) application is a formal process that allows an individual or a business to disclose previously undeclared or incorrect tax information to SARS—before SARS detects it—so that the taxpayer can regularise their tax affairs. It applies to most taxes administered by SARS, including personal income tax, VAT, and employees’ tax (PAYE/SDL/UIF), but generally excludes Customs and Excise matters. If accepted, SARS may grant relief from qualifying penalties and criminal prosecution, while the underlying tax and interest remain payable.

To qualify, the disclosure must generally be voluntary, full and complete in all material respects, made in the prescribed manner, and submitted before an audit or investigation into the same default is underway. The disclosure must also not result in a refund being due by SARS.

How does it work?
A VDP application is submitted via SARS eFiling (or through a SARS branch where applicable). It typically includes a full description of the default, the tax types and periods affected, and supporting calculations/documents. SARS will assess whether the disclosure is voluntary, full and complete, and made before an audit or investigation is underway for the matter disclosed. Note: VDP relief does not eliminate the underlying tax owed—any outstanding tax plus interest is generally still payable.

Why consider a VDP application?
    • Reduce penalty exposure: Where SARS accepts the VDP, understatement penalties may be remitted (in full or in part) depending on the circumstances.
    • Avoid criminal prosecution: Accepted disclosures generally provide relief from criminal prosecution for the disclosed tax defaults.
    • Restore compliance: Correcting historic returns and disclosures helps ensure your tax profile is up to date for banking, tenders, visas, or future SARS verifications.
    • Certainty and closure: A negotiated VDP agreement can provide clarity on amounts due and the steps to finalise outstanding matters.
